Duties to homeless people

If you are homeless, the LA has a duty to assess your position. They may also be required to offer you temporary accommodation whilst they assess your needs and before they offer you permanent housing if you are found to be statutorily homeless.

Offers to homeless people

A Local Authority also has a statutory duty to provide settled accommodation for people who are found to be homeless. This can include properties provided by themselves, a HA or a private landlord.

The Homelessness Code of Guidance (2005) recommends that homeless people should be treated on the same basis as other housing applicants. In general, the profile of offers/lets to homeless people should mirror those of offers/lets to other types of applicants.

The Code of Guidance also identifies placement of homeless people in hard to let housing as poor practice.

Statutorily homeless



This is the phrase that is used for a household which the LA has assessed as unintentionally homeless or threatened with homelessness and owed a duty to permanent accommodation.

Reasonable offer



Social landlords should consider the particular personal circumstances and wishes of their applicants when offering them a house.
